Buying Process Explained
1. Instructing a Conveyancer: Once your offer has been accepted, you will need to instruct a conveyancer.

2. Confirmation of Instructions: Once I have been instructed, I shall send you a bundle of initial documents, including a letter confirming the instructions to you (usually referred to as a Client Care Letter), along with the terms of business and a Client Questionnaire for completion and return. You will need to provide the signed Client Care Letter, your completed questionnaire (included in the pack) along with the valid ID and evidence of proof of address and pay money on account for searches.

3. Conveyancing Searches: conveyancing searches are compulsory if you are purchasing with the aid of a mortgage. However, even if you are a cash buyer, searches are recommended so that you have a full picture of the property you are purchasing. The searches reveal various matters including a potential risk of flooding, the property is connected to mains and whether there are any planning issues.

4. Obtaining Contract Pack: I will liaise with the Seller's Conveyancer to obtain a contract pack (the contract pack usually contains a draft contract along with the title documentation and the Sellers completed Fittings and Contents Form (TA10 Form), the Property Information Form (TA6 Form) and the Leasehold Information Form (TA7 form) (if the latter is applicable).

5. Title Check: Once the contract pack is to hand, I will review the documents, raise enquiries, conduct necessary searches and obtain a copy of the mortgage offer.

6. Mortgage Offer: I will obtain your mortgage offer and will deal with the lender's specific requirements, if any. You will also be provided with a mortgage report and a mortgage deed for execution and return.

7. Replies to Enquiries: The Seller's conveyancer provides replies to the pre-contract enquiries along with any outstanding documents (as well as the leasehold information pack, if applicable and unless it has been provided earlier).

8. Search report: upon receipt of all the search results, I shall provide you with a search report along with all the search results and raise further queries, if necessary.

9. Title Report: I will review the replies to the enquiries and search results and will provide you with a report on title. The report on title will be accompanied with all the documents provided by the seller's conveyancer and the documents for signing as well as a draft completion statement setting out a financial side of the transaction.

10. Exchange of Contracts: Upon receipt of your confirmation that you are fully satisfied with the replies to all the enquiries, the signed documents and deposit (usually 10% of the purchase price), a date for completion can be agreed. Once the contracts have been exchanged, the contracts will become legally binding. I will request release of the mortgage advance from your lender. Some pre-completion checks will also be carried out at this stage (e.g. a bankruptcy search etc unless they have been carried out prior to exchange of contracts which is usually the case).

11. Completion: The balance due from you, should be received in full and clear funds at least one working day prior to completion. Completion is when you get your keys and move into the property. On the completion date, completion monies will be transferred to the Seller's conveyancer, who will then confirm receipt of funds and key release. The applicable stamp duty will also be paid to HMRC on completion and any balance due back to you will also be sent to you.
12. Post Completion: Once the Seller's executed Transfer Deed along with the supporting documentation, if any, have been received and an application for registration will be sent to HM Land Registry. Please note that registration process can take several weeks.

Upon completion of registration, you will receive an up to date Register of Title showing your name as a new registered owner. The up to date register will also be sent to your lender, if applicable, showing your new mortgage registered against the property/title.
